Box 466 Gardner, MA 01440 Dear Ms. Melanson: I have received the petition of Edward O’Brien appealing the nonresponse of the North Central Correctional Institute (Institute) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 1, 2025, Mr. O’Brien requested: [1] The number of all incident reports produced in the years of 2019, 2021, 2022, 2023 and 2024 that contain the following word/search terms: Contraband and visit, contraband and visitor, contraband and visiting room, drugs and visit, drugs and visitor, and drugs and visiting room[;] [2] A copy of the incident reports from request #1. Claiming to not yet have received responsive records, Mr. O’Brien petitioned this office and this appeal, SPR25/1979, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Institute has provided a response. Accordingly, the Institute is ordered to provide Mr. O’Brien with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. O’Brien may appeal the substantive nature of the Institute’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
