Assistant Corporation Counsel Office of the Legal Advisor Boston Police Department 1 City Hall Square Boston, MA 02201 Dear Attorney O’Donnell: I have received the petition of Brian McCarter appealing the response of the Boston Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 17, 2025, Mr. McCarter requested the following: All emails, attachments, or records of crime statistics sent to or from [identified individuals] from January 1, 2023 to the present[.] This request includes, but is not limited to: [1] Statistical summaries or compilations of crime data; [2] Weekly or monthly incident reports; [3] COMPSTAT reports or briefings; [4] Internal crime dashboards, charts, or spreadsheets; [5] Any crime data prepared for or discussed in command staff meetings; [6] Any related emails or documents forwarded, received, or sent by these individuals that include or attach crime statistics. The Department responded on June 18, 2025, assigning the request reference number B001676-061725. Unsatisfied with the Department’s response, Mr. McCarter petitioned this office and this appeal, SPR25/2015, was opened as a result. Subsequently, I learned that the Department provided a further response on July 16, 2025. Where this appeal was opened based on the Department’s June 18, 2025 response, I will now consider this administrative appeal closed. If unresolved issues remain, Mr. McCarter may appeal the substantive nature of the Department’s July 16th response within ninety (90) days. See 950 C.M.R. 32.08(1).
