Assistant General Counsel Boston Public Health Commission 1010 Massachusetts Avenue Boston, MA 02118 Dear Attorney Pasternack: I have received the petition of Brian McCarter appealing the response of the Boston Public Health Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 23, 2025, Mr. McCarter requested, “…copies of what [the Commission’s] staff call ‘union notice’ in the last 12 months, as well as any policy documents that summarize when to notify unions.” The Commission responded on April 4, 2025, April 7, 2025, and April 28, 2025. Unsatisfied with the Commission’s responses, Mr. McCarter petitioned this office and this appeal, SPR25/2032, was opened as a result. Subsequently, I learned that the Commission provided a further response on July 23, 2025. Where this appeal was opened based on the Commission’s April 4, 2025, April 7, 2025, and April 28, 2025 responses, I will now consider this administrative appeal closed. If unresolved issues remain, Mr. McCarter may appeal the substantive nature of the Department’s July 23rd response within ninety (90) days. See 950 C.M.R. 32.08(1).
