Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 7760 Boston, MA 02116 Dear Attorney Ciollo: On July 14, 2025, this office received your petition on behalf of the Massachusetts Bay Transportation Authority (Authority) seeking permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Authority furnished a copy of the petition to the requestor, Andrea Perdomo-Hernandez. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On June 27, 2025, Ms. Perdomo-Hernandez requested “[a]ll emails and/or text messages relating to CRRC materials being held by Customs and Border Protection.” It is my understanding that on July 16, 2025, Ms. Perdomo-Hernandez modified her request to seek “correspondence between the CRRC and the MBTA[.]” Conclusion In light of the decision to modify the scope of the request, I find it unnecessary to opine on the Authority’s fee petition at this time. I encourage Ms. Perdomo-Hernandez and the Authority to continue to communicate directly in order to facilitate producing records more efficiently and affordably. See G. L. c. 66, § 10(b)(vii).
