Fenlon Records Access Officer University of Massachusetts, Boston 100 Morrissey Boulevard Boston, MA 02125 Dear Mr. Fenlon: I have received the petition of Joshua McLain, of UMass Boston Police Department, appealing the nonresponse of the University of Massachusetts, Boston (University) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 11, 2025, Mr. McLain requested the following: 1. Annual budget reports for the UMass Boston Police Department, including total allocated budgets and detailed line items, if available[;] 2. Overtime expenditure records, including: a. Total overtime spending for each fiscal year[;] b. Monthly or quarterly breakdowns of overtime expenditures, if available[;] c. A list of all employees who earned overtime during the requested period, including the total overtime amounts paid to each individual[;] 3. Any documentation, reports, or communications explain significant fluctuations, overages, or budgetary impacts related to overtime spending. Claiming to not yet have received responsive records, Mr. McLain petitioned this office and this appeal, SPR25/2037 was opened as a result. Subsequently, I learned that the University provided Mr. McLain with a response on July 16, 2025. Where this appeal was opened as a result of the University’s lack of a written response, I will now consider this administrative appeal closed. Mr. McLain may appeal the substantive nature of the University’s July 16th response within ninety (90) days. See 950 C.M.R. 32.08(1).
