The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 28, 2025 SPR25/2041 Andre Morgan Records Access Officer Beverly Public Schools 70 Balch Street Beverly, MA 01915 Dear Mr. Morgan: I have received the petition of Stephen Voltz appealing the nonresponse of the Beverly Public Schools (School) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 19, 2025, Mr. Voltz requested: [1] Any emails, memos, or other communications [an identified individual] sent to city employees asking them to search for records responsive to my December 8th request[;] [2] Any responses [an identified individual] received back from city employees or from others regarding their searches (including any responses indicating no records were found), or any work they did gathering or redacting records in connection with my December 8th request[;] [3] Any notes or records [an identified individual] kept documenting which departments or individuals you contacted for the search and/or their responses. Claiming to not yet have received responsive records, Mr. Voltz petitioned this office and this appeal, SPR25/2041, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the School has provided a response. Accordingly, the School is ordered to provide Mr. Voltz with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Voltz may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
