Assistant General Counsel Board of Registration in Medicine 200 Harvard Mill Square, Suite 330 Wakefield, MA 01880 Dear Attorney Douglas: I have received the petition of Liz Kowalczyk, of the Boston Globe, appealing the nonresponse of the Board of Registration in Medicine (Board) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 3, 2025, Ms. Kowalczyk requested: [1] No. of full licensed physicians[;] [2] No. of medical licenses disciplined[;] [3] A breakdown of types of discipline, such as appears on Page 9 of the board’s 2023 annual report in a chart called “Disciplinary Actions.” Claiming to not yet have received responsive records, Ms. Kowalczyk petitioned this office and this appeal, SPR25/2049, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Board has provided a response. Accordingly, the Board is ordered to provide Ms. Kowalczyk with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Kowalczyk may appeal the substantive nature of the Board’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
