Assistant District Attorney Plymouth County District Attorney’s Office 155 Main Street Brockton, MA 02301 Dear Attorney Palumbo: I have received the petition of Murat Erkan, Esq., of Erkan & Sullivan, PC, appealing the nonresponse of the Plymouth County District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 30, 2025 Attorney Erkan requested “the docket numbers of all cases in which your office charged any of the following offenses from October 21, 2021, to present: Manslaughter by MV (G.L. c. 265 s 13 1/2)[;] Homicide by MV while OUI (G.L. c. 90 s 24G (a) or (b)[.]” Claiming to not yet have received a response, Attorney Erkan petitioned this office and this appeal, SPR25/2072, was opened as a result. Subsequently, I learned that the Office intends on providing a written response to Attorney Erkan. Accordingly, the Office is ordered to provide Attorney Erkan with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
