The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 24, 2025 SPR25/2125 John Pozzi Parks and Recreation Director Town of Swansea 81 Main Street Swansea, MA 02777 Dear Mr. Pozzi: On July 18, 2025, this office received your petition on behalf of the Town of Swansea (Town) seeking permission to waive statutory limits to fees and to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Town furnished a copy of the petition to the requestor, Eric Jussaume. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On July 9, 2025, Mr. Jussaume requested “all text messages and emails from Jan 1 2025 to July 9th on [an identified individual][.]” Subsequent to the opening of this petition, in an email to the Town and this office on July 18, 2025, Mr. Jussaume stated, “…we are going to disregard the public records request at this time[.]” In light of the decision to withdraw the request, I find it is unnecessary to opine on the Town’s fee petition at this time.
