See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 4, 2025, Mr. Saia requested: [1] Any public records that identify Encore’s contribution so far towards the $10M committed in section 4.2.A of its surrounding communities agreement with Malden for the purchase of goods and services from vendors with a principal place of business in Malden. [2] Any public records that identify which local business in Malden have become “Wynn certified” in the local purchasing program described in 4.2.B of its surrounding communities agreement with Malden. [3] Any public records that identify rewards, frequent guest, loyalty and/or similar programs offered by Wynn to use voucher and gift certificates to Malden businesses, as described in 4.2.C of Encore’s surrounding communities agreement with Malden. [4] Any public records that account for Encore’s commitment to annually purchase $25k in gift certificates from local businesses, for the year of 2024. [5] Any public records that would describe current or proposed shuttle lanes to the casino, as described in the first bullet of section 1.1. Joanne Perperian SPR25/2221 Page 2 August 7, 2025 [6] Any separate agreements related to the provision of off-site parking to Wynn (Encore) for individuals that do, may, or will use potential shuttles that reveal between Malden and Encore, as described in the second bullet of section 1.1. The City responded on June 16 and July 22, 2025. Unsatisfied with the City’s responses, Mr. Saia petitioned this office and this appeal, SPR25/2221, was opened as a result. Subsequently, I learned that the City provided Mr. Saia with a supplemental response on August 7, 2025. Where this appeal was opened as a result of the City’s June 16th and July 22nd responses, I will now consider this administrative appeal closed. Mr. Saia may appeal the substantive nature of the City’s August 7th response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Manza Arthur Supervisor of Records cc: John Saia
