O. Box 276 Shutesbury, MA 01072 Dear Ms. Bannasch: I have received the petition of Frank McGinn appealing the response of the Town of Shutesbury (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 1, 2025, Mr. McGinn requested the following: [1] [A]ny and all records from May 1, 2025 through July 1, 2025, pertaining to the appointment of [an identified individual] as the Planning Board representative to the Lake Wyola Advisory Committee[;] [2] [A]ny and all records from May 1, 2025 through July 1, 2025, pertaining to [an identified individual][;] [3] [A]ny and all records from June 2, 2025 through July 1, 2025, of any and all research that was conducted into the Planning Board representative on LWAC, including research into the history of the Planning Board representative on LWAC. In an email correspondence dated July 2, 2025, the Town sought clarification from Mr. McGinn regarding Item 2 of his request. In an email replying to the Town on the same date, Mr. McGinn clarified that Item 2 sought, “any and all records of communications to or from the Select Board as a whole, to or from any individual members of the Select Board, and to or from the Town Administrator, from May 1, 2025 through July 1, 2025, mentioning [an identified individual].” Subsequently, in an email to the Town also dated July 2, 2025, Mr. McGinn modified the scope of Item 2 of his clarified request to “also include records that refer to [an identified individual] . . . or other near misses on the spelling of [the individual’s] name.” One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832 • Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Unsatisfied with the Town’s response, Mr. McGinn petitioned this office and this appeal, SPR25/2273, was opened as a result. Subsequently, I learned that the Town provided a supplemental response to Mr. McGinn on August 11, 2025. Where this appeal was opened as a result of the Town’s July 11, 2025 response, I will now consider this administrative appeal closed.
