The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 7, 2025 SPR25/2279 Debra Cabral Records Access Officer Fall River Public Schools 417 Rock Street Fall River, MA 02720 Dear Ms. Cabral: I have received the petition of Collin Dias appealing the nonresponse of the Fall River Public Schools (School/District) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 7, 2025, Mr. Dias requested the following: [1] All text messages to and from [an identified School employee’s] cell phone . . ., and any other cell phone operated by [an identified School employee] that contain . . . [28 identified] key words . . .[;] [2] All text messages to and from [an identified School employee’s] cell phone . . ., and any other cell phone operated by [an identified School employee] to and from . . . [11 identified individuals] . . .[;] [3] Any emails to and from [an identified School employee] that contain . . . [23 identified] key words . . .[.] The School responded on July 21, 2025, providing a fee estimate. Subsequently, in an email to the School on the same date, Mr. Dias narrowed his request, as described above, and stated, “I hereby withdraw [Item] three and hereby limit [Items] 1 and 2 to a period starting January 1st, 2024 until the date of the original request.” Claiming to not yet have received records responsive to his to his narrowed request, Mr. Dias petitioned this office and this appeal, SPR25/2279, was opened as a result. Subsequently, I learned that the School provided Mr. Dias with a response on August 5, 2025. Where this appeal was opened as a result of the School’s lack of written response to Mr. Dias’ narrowed July 21st request, I will now consider this administrative appeal closed. Mr. Dias may appeal the substantive nature of the School’s August 5th response within ninety (90) days. See 950 C.M.R. 32.08(1).
