See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 29, 2025, Mr. and Ms. Burden requested the following for the period of January 1, 2025 to July 29, 2025: [1] All telephone records and billing statements showing the times and durations of calls made to or from any landline numbers associated with the Lunenburg Police Department[;] [2] All telephone records and billing statements showing the times and durations of calls made to or from any cellular/mobile devices assigned to Lunenburg Police Department officers or staff, or any mobile device under the control of the department. The Town provided responses on July 30, August 1, and August 5, 2025. Unsatisfied with the responses, Mr. and Ms. Burden petitioned this office and this appeal, SPR25/2444, was opened as a result. Subsequently, I learned that the Town provided Mr. and Ms. Burden with an additional response on August 23, 2025. Where this appeal was opened as a result of the Town’s July 30th, August 1st, and August 5th responses, I will now consider this administrative appeal closed. Mr. and Ms. Burden may appeal the substantive nature of the Town’s August 23rd response within ninety (90) days. See 950 C.M.R. 32.08(1).
