See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 28, 2025, Mikhael El-Bayeh requested the following records concerning eight (8) listed citation numbers/docket numbers: [1] Officer’s copy of citation with officer comments[;] [2] All papers filed, served by, or served on the police department in connection with the related appeal to the Appellate Division of the District Court Department, including, but not limited to, the claim of appeal form, motions, interlocutory orders, briefs or memorandums of law, record appendices, audio recordings and/or transcripts of hearings, and the final decision and order of the Appellate Division. Claiming to not yet have received responsive records, Mikhael El-Bayeh petitioned this office and this appeal, SPR25/2448, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mikhael El-Bayeh with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mikhael El-Bayeh may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
