Assistant City Solicitor Law Department City of Worcester 455 Main Street, Room 301 Worcester, MA 01608 Dear Attorney Thompson: I have received the petition of Sandra Zabarsky appealing the response of the Worcester Police Department (Department) to a request for public records. See G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On May 12, 2025, Ms. Zabarsky requested an incident report regarding an identified individual. The Department responded on May 12, 2025 and May 20, 2025. Upon reviewing this information, I find that I am unable to accept this appeal. The Public Records Access Regulations, which govern the procedural aspects of all appeals, require that an appeal to this office be filed within ninety (90) calendar days of the date of the request letter, or within ninety (90) calendar days of the date of a written response from the record custodian. See 950 C.M.R. 32.08(1)(d); 950 C.M.R. 32.08(1)(e). The petition is requesting the appeal of the Department’s May 12, 2025 and May 20, 2025 responses, which exceeds the ninety (90) day limit. Ms. Zabarsky may make a new request to the Department for the same information. The Department would then have ten (10) business days in which to respond to the new request. G. L. c. 66, § l0(a)-(b). If the Department denies Ms. Zabarsky’s request or fails to respond within ten (10) business days, she may appeal to this office within the above timeframe.
