Corner, Esq., of O’Hagan Meyer, appealing the nonresponse of the Town of Franklin (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 7, 2025, Attorney Corner requested: [1] All documents concerning the application to the Franklin Planning Board by Suejo Corp. for Autumn Hills Senior Village, proposed for property located at … and … Summer Street, Franklin, Massachusetts, including all communications from February 1, 2024 to date relative to said application, and including communications concerning the applicant, the subject Property, and/or the owners of the Property[;] [2] [A]ll responsive electronic communications, letters, memoranda, opinions, phone records, voice mail recordings, and any and all other forms of communication to and from all Planning Board members, all Town of Franklin consultants (whether hired by the town or by the applicant) and all Town of Franklin employees, and including all non-privileged communications with Town Counsel and/or Special Town Counsel. Claiming to not yet have received responsive records, Attorney Corner petitioned this office and this appeal, SPR25/2567, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Town has provided a response. Accordingly, the Town is ordered to provide Attorney Corner with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office.
