The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 5, 2025 SPR25/2603 Adam Cooley Lieutenant Orange Police Department 400 East River Street Orange, MA 01364 Dear Lieutenant Cooley: I have received the petition of Freddy Ruiz Jr. appealing the nonresponse of the Orange Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 9, 2025, Mr. Ruiz requested “policy and procedures for [the] Orange Police Department”. Specifically, Mr. Ruiz sought: [1] Policy and [p]rocedures for body camera and audio[;] [2] Stop[,]frisk and threshold inquries[;] [3] Chain of custody for drugs and it’s packaging[;] [4] DNA and or fingerprinting on drug packages ‘outersurface’[‘] [5] [C]hain of custody and evidence report[.] Claiming to not yet have received responsive records, Mr. Ruiz petitioned this office and this appeal, SPR25/2603, was opened as a result. It is my understanding that the Department was notified of this request on September 3, 2025. Subsequent to the opening of this appeal, I learned that the Department intends on providing a written response to Mr. Ruiz. Accordingly, the Department is ordered to provide Mr. Ruiz with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Ruiz may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
