The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 9, 2025 SPR25/2605 Joanne Perperian Public Records Access Officer City of Malden Office of the City Solicitor 215 Pleasant Street, Suite 420 Malden, MA 02148 Dear Ms. Perperian: On September 3, 2025, this office received your petition on behalf of the City of Malden, (City) seeking an extension of time to produce records and requesting permission to assess fees for time spent segregating and redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the City furnished a copy of the petition to the requestor, Brian DeLacey, of Malden News Network. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On August 20, 2025, Mr. DeLacey requested: [1] [A]ny meeting minutes associated with any of the Board of Health meetings held in calendar year 2025 … under all the affordances of Open Meeting Law (ie. NOT under Public Records Law)[;] [2] [A]ny and all meeting documents shared prior to, on the date of, or subsequent to any of the Health Department/Board of Health 2025 meetings, along with any documents (e.g. maps, spreadsheets, databases, tables, letters, complaints, correspondence) used or referred to at these meeting[;] [3] [P]ublic records which [an identified individual] have created, received or shared during calendar year 2025 - including text messages, email, or other forms of communication, reports, files or brochures - which contain any of these word combinations: “rat or rats” “rodent or rodents”, “bait”, “locations”, “trap or traps”. Subsequent to the opening of this petition, in an email to the City and this office on September 3, 2025, Mr. DeLacey withdrew his August 20th request. In light of the decision to withdraw the request, I find it unnecessary to opine on the City’s petition at this time.
