See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 12, 2025, Mr. Shein requested: [a]ll inspections, investigations, and enforcement activities conducted by the Massachusetts Department of Labor Standards’ Workplace Safety and Health Program (WSHP) in Berkshire County from January 1, 2020 to the present. For each inspection or activity, please provide the following information, if available: [1] Date of inspection or activity[;] [2] Inspection number or case number[;] [3] Municipality and worksite name[;] [4] Type of inspection (e.g., complaint, referral, accident/fatality, planned program, follow-up)[;] [5] Nature of hazard(s) investigated (e.g., fall protection, machine guarding, chemical exposure)[;] [6] Outcome (e.g., no violations, Order to Correct issued, penalties assessed)[;] [7] Amount of penalty, if any, and date paid or resolved[;] [8] Status (open, closed, pending)[.] Claiming to not yet have received responsive records, Mr. Shein appealed this office and this appeal, SPR25/2632, was opened as a result. Subsequently, I learned that the Department provided Mr. Shein with a response dated September 10, 2025.
