Cohen, of Boston Dog Lawyers, appealing the response of the Department of Agricultural Resources (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 15, 2025, Attorney Cohen requested “all records related to Fitchburg Friends of Felines and [an identified individual] including but not limited to all: [1] Licenses [2] License applications [3] Citations [4] Complaints [5] Warnings [6] Or other relevant records.” The Department responded on June 10, 2025 and June 18, 2025, but did not provide any responsive records. Unsatisfied with the Department’s responses, Attorney Cohen petitioned this office and this appeal, SPR25/2652, was opened as a result. Subsequently, I learned that the Department responded to Attorney Cohen’s request with an email response sent on September 9, 2025. The Department stated, “[p]lease see the attached regarding your public records request” and included a PDF attachment with the responsive records. Where the basis of this appeal was opened as a result of the Department’s June 10, 2025 and June 18, 2025 responses, I will now consider this appeal closed. Attorney Cohen may appeal the substantive nature of the Department’s September 9th response within ninety (90) days. See 950 C.M.R. 32.08(1).
