See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 22, 2025, Ms. Mooney requested “all correspondence, including submitted reports and DEP’s response to them, from August 1, 2025 between anyone with DEP and anyone, including legal representatives and consultants for and employees and officers of Housatonic Water Works.” The Department responded on August 22 and September 8, 2025. Unsatisfied with the Department’s responses, Ms. Mooney petitioned this office, and this appeal, SPR25/2679, was opened as a result. Subsequent to the opening of this appeal, I learned that the Department provided a supplemental response by email to Ms. Mooney and this office on September 15, 2025. As this appeal was opened based on the Department’s August 22nd and September 8th responses, I will now consider this administrative appeal closed. If unresolved issues remain, Ms. Mooney may further appeal the substantive nature of the Department’s September 15th response within ninety (90) days. See 950 C.M.R. 32.08(1).
