See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 12, 2025, Mr. Gibson requested the following: [1] All documentation stating on 9/12/24 [an identified individual] was on SBCC single cell list[;] [2] All documentation stating the reason on 9/12/24 [an identified individual] was on SBCC single cell list[;] [3] All documentation stating the date [an identified individual] was removed from the SBCC single cell list and who removed [an identified individual][;] [4] [Copies] of March 22, 2024 email[s] from [an identified individual] to [two identified individuals] [with] subject Re Single Cell/GNC[.] Claiming to not yet have received responsive records, Mr. Gibson petitioned this office and this appeal, SPR25/2717, was opened as a result. Subsequently, I learned that the Department provided Mr. Gibson with a response dated September 4, 2025. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Gibson may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
