Chung Records Access Officer Massachusetts Office of the Treasurer and Receiver General 1 Ashburton Place, 12th Floor Boston, MA 02108 Dear Ms. Chung: I have received the petition of Thomas Murray appealing the nonresponse of the Massachusetts Office of the Treasurer and Receiver General (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 31, 2025, Mr. Murray requested the following records: [1] The exact number of Department of Correction employees with the specific job title of Correction Officer I/Head Cook, Job Code E1816C that have retired from state service from July 5, 2018 until Friday, August 29, 2025. In furtherance of this, [I] would like to know how many of those were denied eligibility for a Group 4 pension and were placed in a different group[;] [2] How many active Department of Correction employees holding the same exact job title and code as above have applied for retirement since January 1, 2025 and were told they would be placed into a retirement group other than group four and which group the retirement board determined they were eligible for. Claiming to not yet have received responsive records, Mr. Murray petitioned this office and this appeal, SPR25/2732, was opened as a result. Based on an email dated September 18, 2025 from the Office to this Division and Mr. Murray, I learned the Office intends on providing a written response to Mr. Murray. Accordingly, the Office is ordered to provide Mr. Murray with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Murray may appeal the substantive nature of the Office’s response within ninety days. See 950 C.M.R. 32.08(1).
