The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 26, 2025 SPR25/2733 Jason Stevens Director of Community Development & Planning City of Gardner 95 Pleasant Street, Room 201 Gardner, MA 01440 Dear Mr. Stevens: I have received the appeal of Paul DeMeo appealing the nonresponse of the City of Gardner (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 2, 2025, Mr. DeMeo requested “[a]ll records on grant money given to Candor Realty and or associates within the last five years[.]” Claiming to not yet have received responsive records, Mr. DeMeo appealed this office and this appeal, SPR25/2733, was opened as a result. Subsequently, I learned that the City provided Mr. DeMeo with a response on September 8, 2025 and again on September 17, 2025. Where this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. DeMeo may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
