Records Access Officer Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite 3910 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Robert Bamberg appealing the nonresponse of the Massachusetts Department of Transportation (Department/MassDOT) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 28, 2025, Mr. Bamberg requested: [1] [A]ny detailed maps they may control showing all city, state, and public/private utility lines around [an identified individual’s] home at … Alden Ave[;] [2] [D]etailed maps showing all city, state, public and private utility lines that run through the Point of Pines. Specifically I am looking for maps that include Delano Ave, Alden Ave, and Bickford Ave, along with a span of the Lynnway that abuts each of these 3 streets[.] Claiming to not yet have received responsive records, Mr. Bamberg petitioned this office and this appeal, SPR25/2780, was opened as a result. Subsequently, I learned that the Department provided Mr. Bamberg with a response on September 30, 2025. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Bamberg may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
