Assistant Attorney General Records Access Officer Office of the Attorney General One Ashburton Place, 20th Floor Boston, MA 02108 Dear Attorney Rush: I have received the petition of David Bixby appealing the response of the Office of the Attorney General (AGO) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 31, 2025, Mr. Bixby requested, “[a]ll comments or communications with respect to MLU case #11875 (Town of Chatham bylaw limiting use of Chatham Airport to Type I aircraft) from the following entities:” [1] Federal Aviation Administration[;] [2] MassDOT or MassDOT Aeronautics Division[;] [3] Town of Chatham or Town of Chatham legal counsel[;] [4] Town of Chatham Airport Commission or any legal representative thereof[;] [5] AOPA (Aircraft Owners and Pilots Association)[.] The AGO provided Mr. Bixby with a response on August 14, 2025. Unsatisfied with the response, Mr. Bixby petitioned this office and this appeal, SPR25/2845, was opened as a result. Subsequently, I learned that the AGO provided Mr. Bixby with a supplemental response on October 6, 2025. Where this appeal was opened as a result of the AGO’s August 14th response, I will now consider this administrative appeal closed. Mr. Bixby may appeal the substantive nature of the AGO’s October 6th response within ninety (90) days. See 950 C.M.R. 32.08(1).
