The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 9, 2025 SPR25/2852 Joseph Vizard City Clerk City of Waltham 610 Main Street Waltham, MA 02452 Dear Mr. Vizard: I have received the petition of Scott Taylor appealing the nonresponse of the City of Waltham (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 12, 2025, Mr. Taylor requested the following: [1] [A]ll copies of any and all collective bargaining agreements (CBA), memorandums of agreement/understanding (MOA/MOU), side letters, and wage scales between the City of Waltham and the bargaining unit that covers the rank/superior officers of the Waltham Police Department (sergeant, lieutenant, and captain) for the years covering July 1, 2020 through the most recent agreement[;] [2] If there is a full CBA and then only MOAs from some prior fiscal year to the requested period… all applicable agreements through the requested dates[;] [3] …that [identified] rank’s respective union’s agreements with the same time frame and caveats and if not in a union, their individual terms of employment, contracts, and wage schedules as applicable. Claiming to not yet have received responsive records, Mr. Taylor petitioned this office and this appeal, SPR25/2852, was opened as a result. Subsequently, I learned that the City provided Mr. Taylor with a response on September 29, 2025. Where this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. Taylor may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
