See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 10, 2025, Mr. Herman requested copies of “[r]ecords of any and all expenses that [an identified individual] has incurred in his capacity as sheriff of Essex County for the period September 1, 2024 to August 31, 2025” including: [1]) Expense reports, including back-up receipts[;] [2] Credit cards statements, including back-up receipts[;] [3] Automobile expense records, including back-up receipts[;] [4] Any and all other records that document [an identified individual’s] expenses, including back-up receipts[;] [5] The written employee reimbursement policy of the Essex County Sheriff’s office[.] The Department provided responses on September 19, 2025, September 29, 2025 and October 1, 2025. Unsatisfied with the Department’s responses, Mr. Herman petitioned this office and this appeal, SPR25/2921, was opened as a result. Subsequently, I learned that the Department sent a further response to Mr. Herman on October 15, 2025. Where this appeal was opened as a result of the Department’s September 19th, September 29th and October 1st responses, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Department’s October 15th response within ninety (90) days. See 950 C.M.R. 32.08(1).
