The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 4, 2025 SPR25/3152 Wendy Houle Town Clerk Town of Sunderland 12 School Street Sunderland, MA 01375 Dear Ms. Houle: On October 27, 2025, this office received the petition of Michael D’Ortenzio Jr, Esq., of KP Law, P.C, on behalf of the Town of Sunderland (Town) seeking permission to waive statutory limits to fees and to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Town furnished a copy of the petition to the requestor, Michael Pill, Esq., of Green Miles Lipton, LLP. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On October 10, 2025, Attorney Pill requested: [1] All “documents” received by [six identified indivuals] “concerning” anyone or more of the following: [five identified subject matters][;] [2] All “documents” sent or delivered by [six identified indivuals] to any person “concerning” any one or more of the following: [five identified subject matters][.] Subsequent to the opening of this petition, in an email to the Town and this office on October 28, 2025, Attorney Pill stated, “[t]oday I authorized our law firm to send payment to the Town of Sunderland which includes $75 per hour for four hours of Town Counsel’s time instead of four hours at $25 per hour…” Where the requestor intends to pay the fees, I find it is unnecessary to opine on the Town’s petition at this time.
