Merrill Director of Strategic Communications & Media Relations University of Massachusetts – Dartmouth Office of Public Affairs 285 Old Westport Road Dartmouth, MA 02747 Dear Mr. Merrill: I have received the petition of ESU Local (requestor) appealing the response of the University of Massachusetts – Dartmouth (UMass) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 23, 2025, the requestor sought [a] list of employees who occupy university housing, or housing operated under contract by a 3rd party for the university, or housing operated by a 3rd party from which the University normally receives a portion of the compensation for; the fair market value of the room, board, and utilities (e.g. electricity, heat, internet service, etc.) provided to the employee as part of their use of university housing; the dollar amount, if any, the employee reimburses the university for the room/ board/ utilities they receive; and lastly if the housing is provided for as part of their employment contract. On September 29, 2025, UMass provided a response. Unsatisfied with the response, the requestor petitioned this office and this appeal, SPR25/3155, was opened as a result. Subsequently, I learned that UMass sent a further response to the requestor on November 10, 2025. Where this appeal was opened as a result of UMass’ September 29, 2025 response, I will now consider this administrative appeal closed. The requestor may appeal the substantive nature of UMass’ November 10th response within ninety (90) days. See 950 C.M.R. 32.08(1).
