Senior Counsel Massachusetts Development Finance Agency 1350 Main Street, Suite 200 Springfield, MA 01103 Dear Attorney Calnan: I have received the petition of Emma Rindlisbacher appealing the nonresponse of the Massachusetts Development Finance Agency (Agency) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 16, 2025, Ms. Rindlisbacher requested the following records from the period “between [J]an 1, 2022 and the date the search is conducted[:]” [A]ll text messages between [two identified individuals]. . . . Please take an expansive view of the definition of text messages and include both text messages through cell phone telecom as well as text messages through messaging apps (whatsapp, signal, etc). Prior Petition This request was the subject of a prior petition. See SPR25/2856 Determination of the Supervisor of Records (October 3, 2025). In my October 3rd determination, I granted the Agency an extension of 20 business days. Claiming to not yet have received responsive records, Ms. Rindlisbacher petitioned this office and this appeal, SPR25/3185, was opened as a result. Subsequently, I learned that the Agency provided Ms. Rindlisbacher with a response on November 3, 2025. Where this appeal was opened as a result of the Agency’s lack of a written response, I will now consider this administrative appeal closed. Ms. Rindlisbacher may appeal the substantive nature of the Agency’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
