Records Access Officer Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Investigative Media Alliance (requestor) appealing the nonresponse of the Massachusetts Department of Transportation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 9, 2025, the requestor sought: [1] 2025 civil [a]ction (lawsuit) against MassDOT regarding the proposed Palmer, MA railroad station; [2] MassDOT response to above referenced civil action. Claiming to not yet have received responsive records, the requestor petitioned this office and this appeal, SPR25/3187, was opened as a result. Subsequently, I learned that the Department provided the requestor with a response dated October 29, 2025. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. The requestor may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
