The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records November 4, 2025 SPR25/3216 Sergeant Andrew Devito Records Access Officer Billerica Police Department 6 Good Street Billerica, MA 01821 Dear Sergeant Devito: On November 3, 2025, this office received your petition on behalf of the Billerica Police Department (Department) seeking permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, I understand that the Department furnished a copy of this petition to the requestor, Steven Fasano. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On October 20, 2025, Mr. Fasano requested “body camera footage [and] call from [an identified officer]” pertaining to an incident involving an identified individual on October 16, 2025. Subsequent to the opening of this petition, in an email to the Department and this office on November 4, 2025, Mr. Fasano stated, “I no longer require the requested footage or the recorded phone call.” In an email to this office later the same day, regarding its petition, the Department stated, “we can withdraw.” In light of the above correspondence, I find it is unnecessary to opine on the Department’s petition to charge for time spent segregating or redacting responsive records.
