Vizard City Clerk City of Waltham 610 Main Street Waltham, MA 02452 Dear Mr. Vizard: I have received the petition of Matthew Lyons appealing the response of the City of Waltham (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 20, 2025, Mr. Lyons requested: …any and all emails, text messages (SMS), and other forms of electronic communication (including but not limited to instant messages, direct messages, voicemail transcripts, or any other digital correspondence) sent by or to [an identified individual] in his capacity as a city councilor. This request explicitly includes records from both his official City of Waltham accounts and any personal or alternative accounts, phone numbers, or communication platforms used for conducting official city business… from June 1, 2024 to the present date. The City responded on November 3, 2025, providing a fee estimate. Unsatisfied with the City’s response, Mr. Lyons petitioned this office and this appeal, SPR25/3230, was opened as a result. Subsequent to the opening of this appeal, in an email to this office on November 10, 2025, Mr. Lyons stated, “[u]pon further consideration, I would like to formally withdraw my appeal... I am accepting of the city of Waltham’s proposal in this matter.” Accordingly, I will now consider this administrative appeal closed.
