General Counsel Office of the State Auditor One Ashburton Place, Room 1819 Boston, MA 02108 Dear Attorney Leung-Tat: I have received the petition of Chris Van Buskirk, of WBUR, appealing the response of the Office of the State Auditor (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 14, 2025, Mr. Van Buskirk requested the following records: [1] Any and all contracts the Office of the State Auditor has entered into with Donnelly, Conroy & Gelhaar. [2] Any and all requests for proposals (completed or active) that the Office of the State Auditor issued to solicit outside legal counsel in its effort to pursue a legislative audit and enforce ballot question one. The Office responded on November 4, 2025. Unsatisfied with the response, Mr. Van Buskirk petitioned this office and this appeal, SPR25/3273, was opened as a result. Subsequently, I learned that the Office sent a supplemental response to Mr. Van Buskirk on November 20, 2025. Where the basis of this appeal was opened as a result of the Office’s November 4, 2025 response, I will now consider this administrative appeal closed. Mr. Van Buskirk may appeal the substantive nature of the Office’s November 20th response within ninety (90) days. See 950 C.M.R. 32.08(1).
