Whalen, Esq., on behalf of the Chelsea Housing Authority (Authority/CHA), seeking permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, I understand that the Authority furnished a copy of this petition to the requestor, Karen Gage. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On October 27, 2025, Ms. Gage requested what the Authority described as a “276 page report.” Subsequent to the opening of this petition, in an email to this office on November 14, 2025, Attorney Whalen stated, “Ms. Gage has modified her request to which the CHA has informed her that the revised request will be produced with no fee assessed. I anticipate sending her the document today as well.” In a follow-up email, Attorney Whalen confirmed that the Authority wished to withdraw its petition. In light of the above correspondence, I find it is unnecessary to opine on the Authority’s petition to charge for time spent segregating or redacting responsive records.
