Records Access Officer Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Gerald D. Borovick, Esq. appealing the nonresponse of the Department of Transportation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 18, 2025, Attorney Borovick requested, “copies of all form letters the [Registry of Motor Vehicles] has or intends to issue to [non-domiciled drivers of commercial vehicles] concerning Registry transactions including renewal, transfer, upgrade and downgrade of the commercial credential in the [Non-Domiciled Commercial Driver] Program. This would include notice of right to appeal such determinations resulting in adverse action against the driver[.]” Claiming to not yet have received responsive records, the requestor petitioned this office and this appeal, SPR25/3420, was opened as a result. In an email dated November 21, 2025, Attorney Borovick informed this office he is “satisfied with the production received today from the [Department],” and wishes to withdraw the administrative appeal.
