Claire Masinton, Esq., of the Mental Health Legal Advisors Committee, appealing the response of the Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 20, 2025, Attorney Masinton requested: …the following public records for Souza Baranowski Correctional Center (SBCC): 1. For calendar years 2024 and 2025: a. The number of individuals committed to the Recovery Unit (RU) at OCCC. b. The number of individuals sent to the ISOU. c. The number of individuals sent to the ISOU more than once within a 30-day period. d. The number of individuals sent to the ISOU more than once within a 60-day period. e. The number of individuals sent to the ISOU more than once within a 90-day period. 2. For calendar years 2024 and 2025, the number of disciplinary reports issued each month by (i) facility unit, and (ii) severity level of disciplinary report. 3. Current schedules for all programming on offer, including without limit all volunteer-led programs, inmate-led programs, Spectrum Health Systems programs, educational courses, and vocational courses. The three most recent Continuous Quality Improvement (CQI) reports or audits, see 603 DOC 650.20. On October 20, 2025, Attorney Masinton modified her request for Item 2 as follows: “[f]or calendar years 2024 and 2025, the number of disciplinary reports issued each year for SBCC overall and by unit for the following units: (i) STP/STU; (ii) RTU; and (iii) SAU.” The Department responded on October 20, 2025 and November 14, 2025, and assigned reference number R00 1328-102025 to this request. Unsatisfied with the Department’s responses, Attorney Masinton petitioned this office and this appeal, SPR25/3498, was opened as a result. Subsequently, I learned that the Department provided Attorney Masinton with a supplemental response on December 5, 2025. Where this appeal was opened as a result of the Department’s October 20, 2025 and November 14, 2025 responses, I will now consider this administrative appeal closed.
