Rubner, Esq., of the Law Office of Matthew A. Rubner, appealing the response of the Massachusetts Port Authority (Authority/Massport) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 26, 2025, Attorney Rubner requested: 1. Incident Reports & Response Records  All incident/occurrence reports, witness statements, and first-aid or medical assistance reports relating to the [specified] accident.  Any photographs taken by Massport staff or contractors of the scene or of [a specified individual].  CAD/dispatch logs, radio transmissions, paging records, and Airport Operations notifications referencing this incident. 2. Employee & Contractor Information  The names, titles, and department/contractor affiliations of all Massport employees, contractors, or tenant/retail employees who responded, witnessed, documented, or were assigned to the area between 5:00 PM and 6:30 PM on August 12, 2025.  Shift rosters and assignment sheets for personnel responsible for that concourse segment on the incident date. 3. Shannon O’Donnell SPR25/3512 Page 2 December 11, 2025 cameras capturing that concourse segment.  Export logs and metadata associated with the requested footage.  Any video retention or overwrite policy in effect on the date of the incident. 4. Maintenance, Sweeps & Housekeeping Logs  Inspection, custodial, or housekeeping logs (including sweep sheets and zone sheets) for Terminal A, Level 2, covering the incident date and the preceding 30 days.  Custodial schedules and assignment sheets for the incident date.  Work orders, maintenance tickets, or complaints concerning water, leaks, spills, or wet floors in that area for the 90 days prior to the incident.  Weather or water intrusion reports relevant to Terminal A on August 12, 2025. 5. Prior Similar Incidents  Records of prior slip, trip, or fall incidents occurring within the past three years in the same concourse segment, including summary details of location and cause (personal identifying information may be redacted). 6. Policies, Procedures & Contracts  Current Standard Operating Procedures (SOPs) or policies relating to: § Spill response and wet floor remediation; § Sweep frequency and documentation; § Use of wet floor signs, cones, or mats; § Notification of Airport Operations and Risk Management following public incidents; § Retention/export of CCTV and preservation of incident-related recordings.  Training materials and completion records (past three years) for custodial and maintenance staff on slip prevention and spill response.  Contracts, MOUs, or lease provisions allocating maintenance/ housekeeping responsibilities for the concourse/common areas adjacent to “New England Collections.”  Risk Management procedures for intake and handling of public incident claims, including standard incident report templates. 7. Insurance Policies  Copies of any insurance policies, declarations pages, and certificates of insurance (general liability, excess/umbrella, or otherwise) under which Massport, its contractors, or its tenants may provide coverage for bodily injury claims occurring in Terminal A.

Shannon O’Donnell SPR25/3512 Page 3 December 11, 2025  If Massport is insured through private carriers in addition to any self- insurance program, please provide all responsive insurance agreements and risk-pooling arrangements in effect on August 12, 2025. The Authority responded on August 28, 2025. Unsatisfied with the Authority’s response, Attorney Rubner petitioned this office and this appeal, SPR25/3512, was opened as a result. Subsequently, I learned that the Authority provided Attorney Rubner with a supplemental response on December 9, 2025. Where this appeal was opened as a result of the Authority’s August 28, 2025 response, I will now consider this administrative appeal closed. Attorney Rubner may appeal the substantive nature of the Authority’s December 9, 2025 response within ninety days. See 950 C.M.R. 32.08(1).
