See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 6, 2025, Attorney Rubner requested: A. Incident/Response Records [1] Any incident or injury reports generated by Massport Security, Massport Police, or Massachusetts State Police Troop F in connection with this event. [2] Any internal email correspondence, call logs, or dispatch records referencing an injured person or EMS response at Flynn Cruise Terminal on September 19, 2025. [3] Copies of any witness statements, photographs, or written memoranda created or received by Massport personnel relating to this event. [4] Records identifying the Massport employees or contractors who responded or documented the incident. B. Maintenance/Inspection Records [1] Sidewalk and pavement inspection logs, work orders, or maintenance records for Black Falcon Avenue near Terminal 1 during that period. [2] Copies of repair contracts, project plans, or work authorization for sidewalk or curb maintenance in that area within the past 12 months. C. Surveillance/Video [1] Listing of all security cameras covering the exterior of Terminal 1 and adjacent sidewalks as of September 19, 2025. If video is stored on a retention schedule please preserve it immediately pending fulfillment of this request. D. Insurance/Claims Notice [1] Any internal correspondence, emails, or claim forms referencing an injury claim, report, or notice involving [identified individual] or a fall at Flynn Cruise Terminal on September 19, 2025. [2] Names and contact information for the Massport employees or departments responsible for risk management and insurance reporting at the terminal. Claiming to not yet have received responsive records, Attorney Rubner petitioned this office and this appeal, SPR25/3533, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Authority has provided a response. Accordingly, the Authority is ordered to provide Attorney Rubner with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
