LaCivita, Esq., appealing the nonresponse of the City of Brockton (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 13, 2025, Attorney LaCivita requested: [1] All video surveillance footage recorded between 8:30 a.m. and 4:30 p.m. on October 23, 2025 on cameras located in the areas outside the rear entrance of City Hall and around the Dropbox for mail-in ballots near the rear entrance to City Hall[;] [2] All video surveillance footage recorded between 6:00 a.m. and 8:00 p.m. on November 4, 2025 on cameras located in the areas outside the rear entrance of City Hall and around the Dropbox for mail-in ballots near the rear entrance to City Hall[;] [3] The retention policy or policies in effect from October 23, 2025 to present for information recorded on Brockton Police Department video surveillance cameras located in the areas outside the rear entrance of City Hall and around the Dropbox for mail-in ballots near the rear entrance to City Hall[;] [4] Documentation regarding the name of the vendor or vendors who printed all of the ballots requested for the 2025 elections in the City of Brockton including: [eight sub categories of ballots received by the City of Brockton for the 2025 elections][;] [5] With respect to the vendor or vendors referred to in Request No. 4, the invoice for all such ballots received by the Elections Commission[;] One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832 • Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Arnold SPR25/3310 Page 2 December 11, 2025 [6] With respect to the various categories of ballots referred to in Request No. 4, the date all such ballots were received by the Elections Commission[;] [7] Documentation regarding how many ballots were received by the City of Brockton Elections Commission prior to the election on November 4, 2025 including a break down of how many in-person, absentee and mail in ballots were received by the Elections Commission[;] [8] Documentation regarding how many mail in, in person and absentee ballots were sent from the Elections Commission to each individual polling place within the City of Brockton. Claiming to not yet have received responsive records, Attorney LaCivita petitioned this office and this appeal, SPR25/3538, was opened as a result. Subsequently, I learned that the City provided Attorney LaCivita with a response on December 1, 2025. Where this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed.
