See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 16, 2025, Mr. Stoff requested the following: …documentary materials regarding water management at the Alewife MBTA Station. For purposes of this Public Records Request (“PRR”) water management includes any MBTA activity such as planning, engineering, operations, legal or regulatory compliance that involves: - Runoff resulting from rainfall and snowmelt(i.e. stormwater management); - the use of lakes, ponds, streams, and wetlands (i.e. water resource management); - the overflow of water onto land or portions of the Alewife MBTA Station which are normally dry (i.e. flood management)[.] For purposes of this PRR, the Alewife MBTA station includes the parcel identified as … Cambridge Park Drive and assigned parcel ID # 269.5-101 on the Cambridge Assessors Map. The Alewife T station also includes the parcel identified as … Rindge Avenue and assigned ID # 269-127 on the Cambridge Assessors Map. The scope of this PRR also includes parcels adjacent to Alewife MBTA Station over which the MBTA may have easements, licenses, or use agreements involving water management. The MBTA responded on October 29, 2025, assigning the request reference number R001263-101625. Unsatisfied with the MBTA’s response, Mr. Stoff petitioned this office and this appeal, SPR25/3561, was opened as a result. Subsequent to the opening of this appeal, I learned that the MBTA provided a further response on December 12, 2025. Where this appeal was opened based on the MBTA’s October 29, 2025 response, I will now consider this administrative appeal closed. If unresolved issues remain, Mr. Stoff may appeal the substantive nature of the MBTA’s December 12th response within ninety (90) days. See 950 C.M.R. 32.08(1).
