See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 10, 2025, Mr. Brown requested: 1. Situational Judgment Test (SJT) data for all Police promotional exams administered in 2023, 2024, and 2025, for all ranks. [a] Total number of examinees by year and rank; [b] Number and percentage who passed or failed the SJT portion by rank; [c] Mean, median, and standard deviation of SJT scores; [d] Anonymized demographic breakdown of all SJT results, showing performance by race, ethnicity, gender, and veteran status, are sufficient to assess whether outcome disparities exist. [e] Whether the SJT was weighted or unweighted in the final score, and [f] Any internal or vendor-prepared reports, summaries, or analyses Related to the SJT’s fairness, reliability, or performance following The Tatum v. Commonwealth decision. 2. Copies of all vendor contracts, amendments, purchases orders, and procurement materials (including RFP’s and bids) for the 2023-2025 police promotional exams, including those involving the SJT component. Michelle Heffernan SPR25/3616 Page 2 December 15, 2025 Claiming to not yet have received responsive records, Mr. Brown petitioned this office and this appeal, SPR25/3616, was opened as a result. Subsequently, I learned that the Division provided Mr. Brown with a response on December 8, 2025. Where this appeal was opened as a result of the Division’s lack of a written response, I will now consider this administrative appeal closed.
