Assistant General Counsel Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Hugo Billiao appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 13, 2025, Mr. Billiao requested “[a]ll available CCTV footage on the inbound and outbound platforms of Back Bay Station (Orange line) from November 13th, 2025 at 12:30 AM, to November 13th, 2025 at 1:30 AM including those focused on the east side of the outbound track.” On November 19, 2025, Mr. Billiao modified his request to include, “[t]he main cameras that I am concerned with are the ones on the inbound platform towards the inbound side of the station, as well as a camera focused near the emergency call box and kiosk pictured below ... They are the cameras that see the woman in the wheelchair falling onto the tracks...” The MBTA responded on November 19, 2025, December 1, 2025 and December 9, 2025. Unsatisfied with the responses, Mr. Billiao petitioned this office and this appeal, SPR25/3646, was opened as a result. Subsequently, I learned that the MBTA sent a further response to Mr. Billiao on December 24, 2025. Where the basis of this appeal was opened as a result of the MBTA’s November 19, 2025, December 1, 2025 and December 9, 2025 responses, I will now consider this administrative appeal closed. Mr. Billiao may appeal the substantive nature of the MBTA’s December 24th response within ninety (90) days. See 950 C.M.R. 32.08(1).
