The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 29, 2025 SPR25/3705 Ruthy Barros Records Access Officer Massachusetts Commission Against Discrimination One Ashburton Place, Suite 601 Boston, MA 02108 Dear Ms. Barros: I have received the petition of David Chritson appealing the response of the Massachusetts Commission Against Discrimination (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 11, 2025, Mr. Chritson requested: 1. Redacted emails made or received by [a named individual] under unsubstantiated assertions of attorney-client privilege. [The individual] is a regular staff member and not legal counsel for the Commission, therefore her communications to or from non-legal-counsel staff members are public records and not privileged. 2. Redacted non-privileged information such as email headers, including senders, recipients, subjects, sender’s email signatures and titles, etc. Such redactions are unlawful under the Public Records Law. The Commission responded on December 15, 2025, and assigned reference number 25- 583 to this request. Unsatisfied with the Commission’s response, Mr. Chritson petitioned this office, and this appeal, SPR25/3705, was opened as a result. Subsequent to the opening of this appeal, I learned that the Commission provided a supplemental response by email to Mr. Chritson and this office on December 19, 2025. As this appeal was opened based on the Commission’s December 15th response, I will now consider this administrative appeal closed. If unresolved issues remain, Mr. Chritson may further appeal the substantive nature of the Commission’s December 19th response within ninety (90) days. See 950 C.M.R. 32.08(1).
