The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 29, 2025 SPR25/3735 Ashley Ferreira Records Clerk Fall River Police Department 685 Pleasant Street Fall River, MA 02721 Dear Ms. Ferreira: On December 19, 2025, this office received your petition on behalf of the Fall River Police Department (Department) seeking permission to waive statutory limits to fees and to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Department furnished a copy of the petition to the requestor, Brenda Vess, of the Mapfre Insurance Company. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On December 9, 2025, Ms. Vess requested: [1] Color copies of pictures taken from the scene[;] [2] Copies of body camera videos[.] Subsequent to the opening of this petition, in an email to the Department and this office on December 20, 2025, Ms. Vess stated, “…we will process payment.” Where the requestor intends to pay the fees, I find it is unnecessary to opine on the Department’s petition at this time.
