City of Somerville City Hall 93 Highland Avenue Somerville, MA 02143 Dear Attorney Amara: I have received the petition of David Chritson appealing the nonresponse of the City of Somerville (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 14, 2025, Mr. Chritson requested the following: all existing records associated with the investigations and cases of the Somerville Department of Racial and Social Justice (“RSJ”) that involve [Mr. Chritson]— including records in physical, electronic, or any other format—from January 1, 2023 to June 30, 2023, that are in the possession, custody, or control of RSJ, SPD, and/or the City; and must also include all existing physical records, not just emails, including the reports and communications that RSJ made to, or received from, [an identified individual], the Office of the Mayor of Somerville, the City Law Department, and/or SPD[.] Claiming to not yet have received responsive records, Mr. Chritson petitioned this office and this appeal, SPR25/3749, was opened as a result. Subsequently, I learned that the Department provided Mr. Chritson with a response dated December 2, 2025. Where this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. Chritson may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
