The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records December 31, 2025 SPR25/3761 Cara Leiper Executive Director City of Northhampton Housing Authority 49 Old South Street Northhampton, MA 01060 Dear Ms. Leiper: I have received the petition of Jose Cruz appealing the nonresponse of the City of Northhampton Housing Authority (Authority) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 3, 2025, Mr. Cruz requested the following: [1] A complete and final response to both previous Public Records Requests [made by Mr. Cruz], including: Any records, emails, attachments, documents, or disclosures responsive to the requests above[;] [a]ny responsive records that exist in [an identified individual’s] email, [an identified individual’s] physical files, or any [Authority]-issued devices or accounts[;] [and] [a]ny responsive materials held by staff acting on [an identified individual’s] behalf, if applicable[;] [2] [E]mails from [an identified individual] or others at [the Authority] to [an identified individual], with attached ethics disclosures, dated on or shortly after: January 31, 2018[;] February 8, 2018[;] May 8, 2018[;] [and] August 14, 2018[;] [3] [A]ny additional records, correspondence, or disclosures that reference: [three identified individuals] for the period of January 1, 2018 through December 31, 2019, to ensure completeness of the original search[.] Claiming to not yet have received responsive records, Mr. Cruz petitioned this office and this appeal, SPR25/3761, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Authority has provided a response. Accordingly, the Authority is ordered to provide Mr. Cruz with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days.
