Twiss Town Clerk Town of Middleton 48 South Main Street Middleton, MA 01949 Dear Ms. Twiss: I have received the petition of Ron Kuszmar appealing the response of the Town of Middleton (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 6, 2025, Mr. Kuszmar requested: All records, documents, and correspondence – written or electronic – relating to the complaint(s), variance request, or subsequent Board of Health review of my property… This includes, but is not limited to: [1] Letters, emails, memos, and notes[;] [2] Te[x]t messages, phone logs, or call records[;] [3] Meeting minutes, staff notes, or annotations[;] [4] Internal communications or third-party submissions (e.g., neighbors, board members, staff)[;] [5] Any communications that led to the issuance of the abatement letter or were reviewed in relation to the enforcement of Section 270-8 of the Town Code. The Town responded on October 9, 2025 and November 25, 2025. Unsatisfied with the Town’s responses, Mr. Kuszmar petitioned this office and this appeal, SPR26/0047, was opened as a result. Subsequent to the opening of this appeal, I learned that the Town provided a further response on January 20, 2026. Where this appeal was opened based on the Town’s October 9, 2025 and November 25, 2025 responses, I will now consider this administrative appeal closed. If unresolved issues remain, Mr. Kuszmar may appeal the substantive nature of the Town’s January 20th response within ninety (90) days. See 950 C.M.R. 32.08(1).
