See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 24, 2026, Mr. Carson requested: …copies of any records from January 1, 2018 to present related to environmental or occupational exposure testing conducted in or regarding licensed cannabis establishments in Massachusetts, including: [1] Air sampling for endotoxins[;] [2] Mold, fungi, or other bioaerosol testing[;] [3] Particulate/dust sampling related to cultivation or processing[;] [4] Indoor air quality investigations[;] [5] Laboratory reports, sampling sheets, data tables, or consultant reports[;] [6] Inspection reports or findings documenting environmental hazards[; and] [7] Any databases, spreadsheets, or summaries tracking environmental or occupational testing results submitted by licensees or collected by the agency[.] I do not request personally identifying information about workers and accept redactions as needed. The Commission provided responses on December 15, 2025, December 23, 2025, December 29, 2025, and January 7, 2026. Unsatisfied with the Commission’s responses, Mr. Carson petitioned this office and this appeal, SPR26/0075, was opened as a result. Subsequently, I learned that the Commission provided Mr. Carson with further responses on January 16, 2026 and January 21, 2026. Where this appeal was opened as a result of the Commission’s January 7th response, I will now consider this administrative appeal closed.
